Introduction

Fall Safe Online, Lda and the Contractor want to make as confidential (Confidential Information) all and any information related to the software known as “Inspector”.

Please note you are consider a Contractor when you accept our Privacy Terms and Sign Up in INSPECTOR. Therefore, at that moment, you have to comply with the present Privacy Terms

“Inspector” Project

1. INTRODUCTION

FALL SAFE Online, Lda and the contractor agrees and commits to:

1. Keep confidentiality relatively to all the information, verbal, written or other, that is clearly marked as “Confidential”, ahead designated by “Confidential Information” and to use it exclusively for everything necessary for the above mentioned project;

2. The involved parts are not allowed to use at any circumstances, this Confidential Information, except for the purposes indicated on the “Introduction”, as well as should not disclose that information to third parties;

3. All the intervenients with access to confidential information related to this contract and project, must maintain confidentiality as well as to assure that the commitment is fulfilled;

4. At no time get direct or indirectly any rights, titles or interests, derivatives of the possession or use of Confidential Information, or claiming legal rights that somehow are related to the use of patent or anyway related with the process and products derivatives or based in Confidential Information;

5. Without prejudice of its obligations in order to the present agreement, after being asked to return to other partner or destroy immediately every document, containing all the Confidential Information or part of it, including every copies, photocopies and extracts of the same. Consequently do not explore or use Confidential Information to any purpose that is not established on the point 1 of the 1st Article;

6. The intervenients are not allowed to show or pass to third parties, any Confidential Information obtained, without written consent by the owner/ responsible of such information

7. The intervenients are not allowed to reproduce Confidential Information obtained, without the authorization of the owner / responsible of such information;

APPLIANCE

This Confidentiality Agreement does not apply to the written and verbal information:

.a) That has been used after this agreement has been signed, without having been negligence by the part that receives Confidential Information;

.b) The part that provides the Confidential Information and which at present is the knowledge of the part that receives Confidential Information through their own sources and whose knowledge can be demonstrated through any written records;

ENTRY INTO FORCE

The present agreement enters into force on the date the user of INSPECTOR signs up to use the app.

AGREEMENT

The parties agree to submit the resolution of any conflict resultant of the application of this Confidentiality Agreement to the Arbitral Tribunal of Vila do Conde.

DATA PROTECTION POLICY

1. DATA PROTECTION POLICY

Data is collected and processed in the strict respect and compliance with the provisions of the personal data protection legislation in force in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, hereinafter referred to as the GDPR.

This Policy refers to those using our services, interested business partners or customers, prospects and suppliers. This Policy is not applicable to third party users, their websites, products or services. If you disagree with practices described in this policy, you should take all precautions to remove yourself from using our website, services or products.

FALL SAFE® respects best practices in the field of security and protection of personal data and has taken the necessary technical and organizational measures to comply with the GDPR and to ensure that the processing of personal data is lawful, fair and transparent and limited to authorized purposes. FALL SAFE® is committed to the protection and confidentiality of personal data, and has taken the measures it deems appropriate to ensure the accuracy, integrity and confidentiality of personal data, as well as all other rights that the respective holders enjoy.

This Data Protection Policy applies exclusively to the collection and processing of personal data in respect of which FALL SAFE® is responsible for its treatment, in the scope of the services rendered available to its Customers, Users, Suppliers and Employees and in all situations in which a processing of personal data by FALL SAFE® occurs.

2. PERSONAL DATA

Personal data is any information of any nature and regardless of its support, including sound and image, relating to an identified or identifiable person. Any person who can be directly or indirectly identified by reference to a name, identification number, address and one or more specific elements of his physical, physiological, genetic, mental, economic, cultural or social identity.

FALL SAFE®, in the scope of its activities, processes the personal data necessary for the provision of services, such as name, address, telephone number and e-mail address, as detailed information. In case of prior consent of the Customer, User, Supplier or Collaborator, this may be withdrawn at any time, without however, the lawfulness of the treatment made on the basis of the previously given consent being compromised.

3. PROCESSING PERSONAL DATA

The processing of personal data consists of an operation or set of operations carried out on personal data, by automated means or not, namely collection, registration, organization, structuring, preservation, adaptation, retrieval, consultation, use, disclosure, dissemination, comparison, interconnection, limitation, erasure or destruction.

The entity responsible for the processing of personal data, when it is made available and supplied to, is FALL SAFE®, determining the purposes and means of processing the data. For this purpose, if the holder of the personal data needs to contact the data controller, he may do so through the means and contacts indicated below:

4. DATA PROTECTION OFFICER

The Data Protection Officer plays a relevant role in the processing of personal data, ensuring, among other aspects, the compliance of data processing with the legislation in force, verifying compliance with this Data Protection Policy and establishing clear rules of processing of personal data, ensuring that all those entrusted with the processing of their personal data, are aware of how FALL SAFE® treats them and what rights they have in this regard.

5. PERSONAL DATA COLLECTION

FALL SAFE® collects your personal data via telephone, in writing, electronic mail, through its websites, applications and through the Customer area, guaranteeing, where necessary, the prior consent of the holder of the personal data. Some personal data are indispensable to the execution of the contract and, in case of lack or insufficiency of the same, FALL SAFE® cannot make available the product or service in question. If the holder of the personal data is not Customer, User, Supplier or Collaborator of FALL SAFE®, their personal data will only be processed when they are made available, namely by subscribing to the newsletters, in which case the rules of this Privacy Policy will apply. The personal data collected can be processed in a computerized in an automated or non-automated way, guaranteeing in all cases the strict compliance with the legislation of protection of personal data, being stored in specific databases, created for this purpose and the data collected will never be used for a purpose other than that for which it was collected or given the consent by the owner.

6. RECIPIENT OF PERSONAL DATA

Without prejudice to the recipient indicated throughout this Data Protection Policy, FALL SAFE® may communicate the personal data of the Customer, User, Supplier or Collaborator for the purpose of complying with legal obligations, namely to police, judicial, tax and regulatory entities.

7. PURPOSES OF PROCESSING OF PERSONAL DATA

In general, the personal data collected are based on the management of the contractual relationship, the provision of contracted services, the suitability of the services to the needs and interests of the Customer, User, Supplier or Collaborator, namely for the purpose of accessing functionalities services. In addition, personal data may also be processed for the purpose of complying with legal obligations and for the purposes of investigation, detection and prosecution of serious crimes.

8. PERIOD OF DATA STORAGE

The period of time during which personal data are stored and kept by FALL SAFE® varies according to the purpose for which the information is processed. Effectively, there are legal requirements that require you to retain the data for a minimum period of time. Thus, and whenever there is no specific legal requirement, the data will be stored and kept only for the minimum period necessary for the pursuit of the purposes that led to its collection or subsequent processing, under the terms defined by law.

9. THE RIGHTS OF THE DATA OWNER

As owners of personal data, Customers, Users, Suppliers and Employees are guaranteed at any time the right to access, rectify, update, limit and erase their personal data (except as regards the data that are indispensable for the provision of the services by FALL SAFE®, duly identified as being mandatory supply or compliance with legal obligations to which the controller is subject), the right to oppose the use of the same for commercial purposes by FALL SAFE® and to withdraw consent without compromising the lawfulness of the treatment effected under this consent, as well as the right to the portability of the data.

Without prejudice to the determined in the GDPR, the holder of the personal data may do access, rectify, update, limit, delete, oppose to the data processing or remove consent, directly or through a written request, addressed to the person responsible for the data processing, through the contacts made available for this purpose in this document, as well as other contacts made available by FALL SAFE ®.

10. MARKETING PURPOSES

FALL SAFE® may promote itself through marketing to its Customers, Users, Suppliers and Employees, for example to promote new products or services, namely through telephone, e-mail, SMS, MMS or any other electronic communications service, if the personal data holder has given his consent. If the holder of personal data does not intend to continue to receive these communications, he may at any time withdraw his consent to the use of his data for marketing purposes.

11. COMPLAINTS

Without prejudice to being able to submit complaints directly to FALL SAFE®, through the contacts made available for this purpose, the Customer, User, Supplier or Contributor may directly complain to the Control Authority, which is the National Data Protection Commission (CNPD) using the contacts made available by this entity for this purpose.

12. FALL SAFE® MEASURES TO ENSURE THE SAFETY OF YOUR PERSONAL DATA

FALL SAFE® is committed to ensuring the protection of the personal data that is made available to it, and approve and implement strict rules in this regard. Compliance with these rules is an obligation of all those who legally access them. Bearing in mind the concern and commitment that FALL SAFE® reveals in the defense of personal data, a number of security measures, technical and organizational have been adopted to help protect the personal data that are made available to it. In addition, third parties that, in the scope of the provision of services, process the personal data in the name and on behalf of FALL SAFE®, are obliged in writing to carry out technical and (in particular, the protection of the privacy and personal data of Customers, Users, Suppliers and Employees). Although data transmission over the internet or website cannot guarantee complete security against intrusions, we and our service providers make every effort to implement and maintain physical, electronic and procedural safeguards designed to protect your personal data at all times with the applicable data protection requirements. Among others, we have implemented the following:

• Transfer of data collected only in encrypted form;

• Protection of information technology systems through firewalls, in order to prevent unauthorized access to your personal data;

• Continuous monitoring of access to information technology systems in order to prevent, detect and prevent the misuse of your personal data. Notwithstanding the security measures adopted by FALL SAFE®, FALL SAFE® alerts all those who surf the Internet that they should take additional security measures, namely to ensure that they use a PC and a Browser updated in terms of patches. properly configured, with active firewall, anti-virus and antispyware, and to ensure the authenticity of the websites they visit on the internet, and avoid websites whose reputation they do not trust.

13. COMMUNICATION OF DATA TO OTHER ENTITIES (THIRD AND SUBCONTRACTED)

FALL SAFE®, in the scope of its activity, may resort to third parties to provide certain services. Sometimes the provision of these services implies access by these entities to the personal data. When this happens, FALL SAFE® takes the appropriate measures, in order to ensure that the entities that have access to the data are reputed and offer the highest guarantees at this level, which is duly established and contractually safeguarded between FALL SAFE® and the third party(ies). In this way, any entity outsourced by FALL SAFE® will treat the personal data of our Customers, Users, Suppliers and Employees in the name and for the account of FALL SAFE® and taking the necessary technical and organizational measures to protect personal data against the destruction, accidental, unlawful, accidental loss, alteration, dissemination or unauthorized access and any other form of illicit treatment. In any case, FALL SAFE® remains responsible for the personal data made available to it.

14. PERSONAL DATA TRANSFERENCE

The provision of certain services by FALL SAFE® may involve the transfer of your data outside of Portugal, including outside the European Union or to International Organizations. In such a case, FALL SAFE® shall comply strictly with the applicable legal provisions, in particular as regards the determination of the suitability of the country(ies) of destination as regards the protection of personal data and the requirements applicable to such transfers, including, always applicable, the conclusion of the appropriate contractual instruments and that guarantee and respect the legal requirements in force.
